About cost budget
The majority of Multi Track matters are now subject to Costs Management Orders. Recent case law suggests that the Court will not deviate from the approved Costs Budget without good reason (which is not always straightforward to prove).
As the case progresses your Costs Budget will require updating and you may have to make an application to update the Costs Budget.
If this is not done on time then it could prove difficult to recover any costs which have moved outside of the approved Costs Budget.
At the conclusion of the matter, if costs cannot be agreed then the matter will proceed to
detailed assessment where a Bill of Costs has to be prepared allocating all work done
(including routine communications) to the appropriate phase.
Our experience has shown that the costs claimed in the Bill of Costs can often be greater per phase than the approved Costs Budget, particularly with regard to pre-action costs restricting recoverability of costs outside the Costs Management Order.
